This policy describes the terms and conditions to be applied to the use of our services available on Neonisi, which you will be asked to agree during the registration.
If you need further information, please contact us, filling in the apposite form. However, in case of general requests, we suggest you to use the forum for a faster answer.

Requirements for the registration and prices

Our services cannot be applied by under 18 years people or by temporarily or definitively suspended users. Your account and your user ID cannot be transferred or given to third party. The registration to Neonisi and the employment of our services are totally free.

Neonisi’s role

Neonisi is not an auctions house. It is important to understand that we do not carry out any intermediation activity nor we are an “auctioneer”, in the traditional meaning. Neonisi is a place that offers to its users the chance to sell and buy items, at any time, from any Internet station and in different ways, included fixed- and dynamic-price selling, usually called “online auctions”. Neonisi has no control or responsibility upon quality, safety, legality of the goods selling. We cannot check the truth and the accuracy of advertisements or the user’s ability to sell, buy and bid. Neonisi has no role in the buying and selling between user, after their activity on the website.
Security of transactions. Neonisi will apply to keep the platform as safe as possible, through the check of every registered user and the immediate expulsion in case of violation of these terms of use. However, Neonisi cannot answer for any damage, direct or indirect, suffered by any user. We invite you to collect all the information about people you intend to make a transaction with and, for this purpose, you can also make use of the feedbacks system based on users prompts. According to the D.Lgs. 70/2003 and the Directive 31/2000/CE about Electronic Commerce, Neonisi is not subjected to any surveillance obligation upon the activity on its own website.
Exclusion of liability. Since Neonisi has no intermediation or checking role in the transactions, in case of polemic, the users contract to exclude Neonisi from any liability nor to ask for damages of any type.
Check of information. Neonisi has no check upon the items for sale provided by user through our site.

Bid and buying

Your bid, in obedience of this agreement, is a commitment. Make a bid only if you intend to buy the good and remember that, if you win the item, you are compelled to respect the commitment. When you make a bid to an item, you contract to automatically agree to the buying conditions of the description. The bids cannot be removed.

Auctions and selling

Items for sale’s description. In order to sell an item on Neonisi, you must own it legally and describe it accurately. Your auctions can only contain a textual description, graphic or some pictures describing the item for sale. All the items have to be inserted in the appropriate category.
Fraud. In addition to the other punishment provided by law, Neonisi reserves to suspend your account in case of undertaking of fraudulent activities.
Fake bid up. To factitiously increase the item’s price or interfere with other’s auctions is a violation of this agreement. In particular, you cannot make a fake bid up on a item.

Your information

Definition. Your personal information are all the data you communicate to Neonisi or to other users during the registration, the presentation of bids, the putting on sale, the sending of message on the forum, the feedbacks or through the services offered.
Limits. Your personal information and your activities must not:
  1. be false, inexact or misleading;
  2. violate the author’s, intellectual property’s and industrial rights of third;
  3. violate the right to discretion and to protection of people, regarding the treatment of their personal information;
  4. violate the norms of law or of regulation (included, e.g., the normative upon the import-export of goods, the consumer’s safeguard, the unfair competition, the racial discrimination and the deceptive adverts);
  5. contain slanders, calumnies, threats or persecutions;
  6. be obscene or contain pornographic material;
  7. contain virus or other software turned to damage, interfere, intercept or embezzle operative systems, data or personal information;
  8. cause any type of harm to Neonisi;
  9. cause a total or partial interruption or suspension of our suppliers’ service.
Licence. With this agreement, you authorize Neonisi to publish the information you provided and give to Neonisi an irrevocable licence of use, freely and transferable of author rights, of other rights of intellectual property, as well as of your image right, regarding your personal information. Neonisi will treat your personal information in respect of the privacy policy.

Access and interferences

Agreeing with this rules, you accept not to use automatic software or mechanisms and not to copy our web pages or their content without our written authorization.. You accept not to use software or mechanism that can disturb the right work of Neonisi. You accept not to do any action that can cause an unreasonable surcharge of the activity of our technological infrastructures and of our system. Most part of available informations on our site is real time updated and it is of our own property or licensed by our users. So you accept not to copy, reproduce, modify or reveal this contents (with the exception of your personal information) without our written authorization or the explicit consensus pf the owners of the intellectual property rights on that contents.

Suspension and exclusion

With the exception of the ordinary punishments of the law for non-respecting obligations of this rules,Neonisi retains a right of sending you an advice, suspend you for an open-ended or fixed term time, interrupting supplyof our services in case of:
  1. violations of this rules;
  2. impossibility for Neonisi to verify your informations given in registration phase or using services;
  3. Making actions that could create big economical damage or legal responsibility to Neonisi or to other users.

Offensive statements

It is possible that other users express judgements on your behaviour that you can consider false or damaging of your repute. In this case, notwithstanding the deletion or not of this statements, Neonisi is not respnsible for this contents, because it cannot verify these ones. Neonisi retains a right to remove a feedback comment or a message published on the site at its discreption.

Guarantee

In the terms of the law, and with the exception of all consumers, Neonisi offers its services "so as they are", with no other guarantees.

Limitations of responsibility

In the terms of the laws, and with the exception of all consumers, Neonisi cannot absolutely be responsible of economical losts, direct or indirect damages, also too the repute, potentially stood by users or from other persons as a consequence of the usage of the site or of its services. Agreeing with the present rules, you accept to keep Neonisi protected from any request or claim of compensation of damages made by other users, that could come from the violation of one or more conditions of this rules, the obligation of the law or the rights of other persons.

Uniformity of the law

All users of Neonisi must respect national and international laws and rules for the usage of services.

Autonomy of the parts

Neonisi and its users act in full autonomy and indipendence. Present rules don't create any relationship of collaboration, agency, association, intermediation or subordinate job.

Advance notice

Neonisi in the future retains the right to modify present rules without any preventive advice. These ones will be operative as soon as they will be published.
